1. – Acceptance of the general terms of use and access to the website
By contracting services through the Website, Users accept these General Terms of Use, which define the rights and obligations of NWU and Users in accessing, browsing and using the Website.
These are the only General Terms of Use applicable to the Website, without prejudice to the particular conditions that may apply for certain and specific services of the Website. The General Terms of Use also apply to the contracting of services and thus replace any other condition, except in the case of written agreement, stipulated in advance, between NWU and the User.
For access to the Website, Users will not be required to register.
2. – Contents and purposes of the website
NWU has created the following website to enable users to book activities, excursions, guided tours and events in Naples and other cities in Italy.
Through the Website, NWU also offers a transfer service that allows users to have private vehicles to move from one place to another in the city where the User is located.
NWU informs that the activities, excursions, guided tours, and transfers are provided by third-party companies which collaborate with NWU (hereafter: the Supplier/s). THROUGH THE WEBSITE, NWU ONLY OFFERS A RESERVATION SERVICE FOR ACTIVITIES, EXCURSIONS, GUIDED TOURS, EVENTS AND TRANSFERS , IN DIFFERENT LOCATIONS IN ITALY, WHICH ARE CARRIED OUT BY SUPPLIERS.
3. – Booking with NWU
To make a reservation on the Website, Users must provide their personal data (name, surname, e-mail, telephone number) or data of the person in whose name the booking of the activity or transfer is made, so that NWU can manage the reservation requested by the User. The data provided will be used exclusively for the purpose of the booking and will be processed in accordance with current legislation on privacy.
By accepting these General Terms of Use, the User declares to be older than 18 (eighteen) years old and to understand and accept the contents of these Terms. In the event that the User is younger than 18 (eighteen) years old, the consent of his / her parents, guardians or legal representatives is required for the acceptance of the provisions of these General Terms. In the latter case, please contact NWU at the following address: info@napleswithus.com.
In accordance therewith, underage Users who purchase NWU products on the Website, by accepting these General Terms and Conditions of Use, warrant that they have been duly authorized by the owner of the bank account to communicate them to NWU and complete the corresponding payment for the services booked.
NWU will not be responsible for user that book the services of NWU in violation of the provisions illustrated in the previous paragraphs.
4. – Terms for the booking of activities, excursions, guided tours or events
The reservations that each User makes through the Website are subject to the specific terms of each activity, excursion, guided tour or event. The User will find the terms of the services in their descriptions of the Website, but also in the confirmation email that will be sent by NWU after the reservation has been made.
4.1. – General terms applicable to all bookings.
The booking of activities, excursions and guided tours offered by NWU on the Website is subject to the following terms:
• The dates and hours of activities, excursions, guided tours and events published on the Web site, generally speaking, may not be modified by the user. It will be possible to change the date and time of an activity, excursion, or guided tour, only if the User has booked a private service, in which case he will have to communicate his request to NWU by sending an email to info@napleswithus.com. In any case, NWU’s response will depend on the terms applied by the Suppliers.
• The User can request to modify the data of his reservations if the terms of the activity, of the excursion, of the guided tour or event allow it, by sending an e-mail to info@napleswithus.com. These requests will be promptly replied to.
• The advance time for each booking varies depending on the activity, excursion, guided tour or event you wish to book. The length of the advance time is visible on the description of the activity on the Website. It is not possible to book an activity with a shorter advance time than that indicated in the calendar.
To pre-book an activity, excursion, guided tour or event, please contact NWU by sending an email to info@napleswithus.com. The reservations that each User makes on the Website are subject to the specific terms applied to each activity, excursion, guided tour or event. The User will find these terms indicated on the Website, in the description of each of these services.
4.2. – Specific terms on the services offered.
The meeting place, date, time, duration, and all the necessary information to book the activities, hiking, sightseeing tour or event are indicated on the Website in the description of each service, as well as in the confirmation email that NWU will send to the User after the reservation.
NWU will send a confirmation email with all the necessary information about the booked service and the reservation ticket for the activity, excursion, guided tour or event booked. Users are required to produce the reservation ticket at the beginning of the activity, either in paper or electronic form.
NWU will not take any responsibility if the User does not present this ticket.
It is essential that users appear at the meeting point on the date and time indicated in the ticket, since all activities, excursions, guided tours and events. These are scheduled to start at a specific time and it is not possible change the start time.
5. – Specific terms of transfer bookings
Each of the transfer services offered by NWU on the Website is subject to specific terms, which Users may consult on the Website in the description of the chosen transfer or in the email sent by NWU as confirmation of the reservation.
Notwithstanding the foregoing, Users must take into consideration the following terms:
• Private Service: The transfer service offered by NWU is private and therefore may only be used by users who have booked this service.
• Vehicle seating: The number of seats indicated on the Website is the maximum number of people who can travel in the vehicle in addition to the driver. There is no difference between children and adults.
• Stopping in the way: If the users have to make stops on the way, these stops will create extra costs.
6. – Economic terms of reservations
The prices will be those indicated by NWU when the activity is booked. In general, NWU charges the full amount of the activity, excursion, guided tour and event booked by the User on the Website where it has been booked. However, it will be possible to request additional services, the cost of which can be paid via the website or when using the service.
Prices are listed in Euros (€) and include taxes. The total amount will be communicated with the booking confirmation. Payment may take the form of credit card, debit card or PayPal.
In general, NWU will not apply discounts for the provision of its services, unless it is established in the terms of the activity, excursion, guided tour, event and / or corresponding transfer.
After making the reservation, the User will receive a confirmation email, with the payment details for the booked service.
Users must notify NWU of any type of unlawful debit to the credit card used for the purchase, through the email info@napleswithus.com, so that NWU may promptly respond.
7. – Cancellation policy
Each of the services advertised by NWU on the Website (activities, excursions, guided tours, events) has a specific cancellation policy, which each User can consult in the description of the activity (on the Website) and in the confirmation email that NWU sends when the reservation is made.
The cancellation terms will be applied to each service, which will set the cancellation deadline and the relevant penalties.
Ultimately, NWU will manage cancellations, as provided for in the cancellation policy of each activity, excursion, guided tour, event or transfer.
The organizing company reserves itself the right to cancel the tour without notice for reasons of force majeure with the sole obligation to reimburse the cost of the tour (Article 10 of the International Convention on CCV Travel Contracts of 23 April 1970 ratification by law n 1084 of 27.12.1977).
In the case of changes to timetables and / or itineraries for reasons not dependent on the organizing company, no reimbursement is foreseen.
The organizer takes no responsibility for any loss of property and personal valuables left by customers on board of buses and other means of transportation. It also will not take responsibility for total or partial closure of museums, monuments and churches and for any delays, irregularities or damage that they should cause to customers and their belongings due to third parties’ fault during excursions or trips.
The following penalties will be applied in case of cancellations:
• Within 72 hours from the start of the booked service: no penalty, except management costs.
• No presentation: 100% penalty.
Customers must notify in writing by registered letter any complaints or dissatisfactions, or if they consider there have been faults or errors from the organization, no later than 10 days from the date of the tour:

IN COMPLIANCE WITH WHAT DECLARED PRECEDENTLY AND BY ACCEPTING THESE GENERAL TERMS OF USE, USERS DECLARE TO HAVE READ AND ACCEPTED THIS CANCELLATION POLICY AND TERMS OF CANCELLATION OF ACTIVITIES, EXCURSIONS, GUIDED TOURS, EVENTS AND / OR TRANSFERS BOOKED ON THE WEBSITE.
8 . – Opinions, comments, communications and other contents
Users who have booked activities, excursions, guided tours, events and / or transfers of NWU will be able to publish their opinions and evaluations on the Website and on social networks.
NWU will send an email to the User after the activity has been completed, so that it can evaluate the experience and the service offered by NWU.
When NWU receives the opinion and evaluation of the User, it will review it and publish it as soon as possible on the Website.
In any case, NWU will publish the opinions of Users only if the content is not unlawful, obscene, abusive, threatening, defamatory, infringes the privacy of third parties or is censurable by third parties and if their content does not have ads or links to other websites and / or that the opinion does not correspond to the assessed service.
NWU reserves the right not to publish opinions whose content may include the following expressions:
i. Discriminatory expressions: discriminatory expressions against individuals and which violate the right to honor, to personal and family intimacy, to one’s own image and to the dignity of the person are in no case allowed. Any kind of discriminatory publication is forbidden for reasons of race, sex, religion, opinion, nationality, disability or for any other personal or social circumstance.
ii. Illegal activities: No contents promoting illegal activities or with obscene or defamatory content are permitted.
iii. Violence: Opinions containing expressions that promote violence and / or include, but are not limited to, sexual violence or violence against animals and people, are prohibited.
iv. Degrading content: Those opinions or comments that are intimidating, threatening, degrading or that promote violence against a person or a specific group of individuals are not permitted.
9 . – Exclusion of liability
In an illustrative but not restrictive manner, NWU will not be responsible for the following circumstances:
i. Cancellations made by the User outside the cancellation deadline. NWU will not be responsible for refunding Users when the terms of cancellation, provided by the cancellation policy applied for each service, have not been respected .
ii. Delays and errors committed by Users to reach the meeting point of the activity, excursion, guided tour and / or transfer booked. NWU will not take any responsibility if the User misses the activity or the transfer due to delays or for otherwise not arriving at the arranged meeting point.
iii. If the user is denied access to the activity, excursion, event, transfer and / or tour match, due to the failure to produce the reservation as hard or digital copy on a mobile phone.
iv. Damages and theft that harm the user and his assets during the activity, excursion or guided tour and / or during the journey of the booked transfer service.
v. Injuries, damages and accidents suffered by the User during the activity, excursion, guided tour and / or private transfer, as well as the injuries, damages and accidents suffered by the User before the service, preventing its realization.
vi. Weather conditions in which the activities, excursions and guided tours , events booked by the User will take place. Under no circumstances will NWU be responsible for these circumstances and the activity, excursion, event, transfer or guided tour will be considered correctly executed.
NWU does not offer any warranty and is exempt from liability for damages of any kind, which derive from accessing and using the content or the Website. NWU is not responsible for the following circumstances:
viii. Lack of availability, management and effective operation of the Website and / or its services and contents, as well as damages and prejudices of any nature caused by lack of availability or continuity of the operation of the Website.
ix. Any technical problems caused by third parties or force majeure, which prevent the proper functioning of the Website.
x. Force majeure, such as technical problems or interruption of services or of use of the Website, as a result of Internet blockade, actions or omissions of third parties or any other cause or circumstances, independent of the will of NWU, which prevent the normal use of the Website.
xi. Illicit, negligent, fraudulent use, contrary to the terms of these General Terms of Use or good faith, of the Website, by Users.
NWU reserves itself the right to take the legal actions against Users, with regard to the circumstances described above and, in general, if these infringe the General Terms of Use.
10 . – Intellectual property
10 . 1.- Industrial Intellectual Property of the NWU Website
All rights to the content, design and source code of this Web Site and, above all, including but not limited to, all rights to photographs, images, texts, logos, designs, brands, trade names, and data included on the Website and any other intellectual and industrial property right and are the property of NWU or third parties, who have explicitly authorized NWU for their use on the Website.
For what is claimed and for the Italian legislation in force on the subject, the reproduction, transmission, use, translation, distribution, public communication, the provision of all or part of the contents of the Website is expressly prohibited, in any medium and for any technical means, except with prior written authorization granted by NWU.
NWU does not grant any license or authorization to use any kind of intellectual and industrial property rights or any other right on the Website. All the clauses of these General Terms of Use must be interpreted independently and singularly, as the rest of the clauses are not involved if one of them has been declared void by a judicial sentence or by a specific legal decision. The clause or clauses will be replaced when necessary, preserving the purposes of the General Terms of Use.
13 . – Jurisdiction and applicable law
These General Terms of Use are governed by Italian law. In case of dispute over the interpretation, execution or validity of these General Terms of Use, the matter will be the responsibility of the Court of Naples.
